In compliance with the information duties pursuant to art. 52, paragraph 1, letters (f) and (g) of
Legislative Decree of September 6, 2005, no. 206 (the “Consumer Code”), the following terms and
conditions are indicated that govern the right of withdrawal in favor of the consumer.
Here are the necessary instructions, so that each Customer can validly exercise the right of
withdrawal, as well as the consequences of exercising said right of withdrawal.
The consumer has the right to exercise the right of withdrawal from the contract.
Consequently, the right of withdrawal can be validly exercised within 14 (fourteen) days from the
date of delivery of the item.
However, the right of withdrawal is excluded concerning Products purchased on MOOORE that are
sealed and not suitable to be returned for reasons of hygiene or related to health protection if they
have been opened after delivery, such as, for example, cosmetic products for body care and
beauty. If the customer intends to return the purchased Products, they must contact MOOORE’s
customer service through the appropriate section on the website and receive the necessary
information to proceed with the return. Please use only the documentation provided by Customer
Service for the return to avoid the loss of the returned order.

 


Information on the right of withdrawal (pursuant to art. 49, paragraph 1, letter (h) of Legislative
Decree no. 206/2005 “Consumer Code”)

The customer has the right to withdraw from the contract, selecting one of the reasons present on
the standard withdrawal form downloadable at the bottom of this page and indicated in art. 6.1. of
the general sales conditions available on the website, within 14 days. The withdrawal period
expires after 14 days from the day the customer or a third party, other than the carrier and
designated by the customer, acquires physical possession of the last ordered good. In the case of
a contract related to multiple goods ordered by the customer in one order and delivered separately,
the 14-day period starts from the day the customer or a third party, other than the carrier
designated by the customer, acquires physical possession of the last good. To exercise the right of
withdrawal, it is necessary to inform MOOORE (Openamic S.r.l., with registered office at 20138
Milan (MI), via Marco Fabio Quintiliano, 24, fax/telephone 02/3666 9669, email:
customer@mooore.com) of the decision to withdraw from the present contract through any explicit
statement to that effect (for example, a letter sent by post, fax, or email).
Where the customer decides not to use the attached standard withdrawal form, they must submit
any other explicit and motivated declaration of their decision to withdraw from the contract. It is
also possible to electronically fill out and submit the standard withdrawal form or any other explicit
statement to that effect through MOOORE’s website. In this case, MOOORE will promptly send a
confirmation of receipt of the withdrawal by email. The deadline for withdrawal is considered
respected if the customer sends their statement before the expiration of the 14-day period starting
from the day the customer or a third party, other than the carrier and designated by the customer,
acquires physical possession of the last ordered good. In the case of a contract related to multiple
goods ordered by the customer in one order and delivered separately, the 14-day period starts
from the day the customer or a third party, other than the carrier designated by the customer,
acquires physical possession of the last good.

 


Effects of Withdrawal

Following the withdrawal from this contract, MOOORE will refund all payments made by the buyer,
including delivery costs (except for any additional costs resulting from the choice of a different type
of delivery than the standard one offered by MOOORE), without undue delay and in any case no
later than 14 days from the day MOOORE is informed by the customer of the decision to exercise
the right of withdrawal. Such refunds will be made using the same payment method used by the
User during the purchase unless otherwise agreed. In any case, the customer will not incur any
costs as a consequence of such reimbursement. The refund may be suspended until receipt by
MOOORE of the products subject to the return or until the customer demonstrates the shipment of
such goods, if earlier. The customer is required to return or deliver the products without undue
delay and in any case within 14 days from the day they communicated their intention to withdraw
from the sales contract.
The Products must be:

properly packed in their original packaging, in an adequate state of preservation (not damaged,
impaired, or soiled), and provided with all their accessories, instructions for use, and
documentation;
equipped with the transport document (present in the original packaging) to allow MOOORE to
identify the customer (order number, name, surname, and address);
without any signs of use other than those compatible with the performance of a normal test of the
item. They must not bear any trace of prolonged use (over a few minutes) beyond the time
necessary and appropriate for a test;
not be in such a condition as to prevent their resale.
If the returned product does not comply with the provisions of the previous paragraph, or if it falls
under the exception to the right of withdrawal indicated in paragraph 6 concerning sealed products,
the withdrawal will not be effective. The costs of returning the goods are borne by MOOORE,
provided that the customer uses the return documents provided by MOOORE and ships the goods
from the country where the delivery took place. Otherwise, the costs of returning the goods will be
borne by the customer. The User is responsible for any decrease in the value of the goods
resulting from any handling of the goods other than that necessary to establish the nature,
characteristics, and functioning of the products.

exercise the right of withdrawal by communicating to MOOORE any other explicit declaration of
